Tracking Down That Elusive Landlord for Your Lease Extension

If you are looking to extend the lease on your leasehold property and have found it virtually impossible to locate the landlord, this scenario can prove to be very frustrating – all too often, people think that they will not be able to proceed with the relevant lease extension. One of the roles of experienced lawyers in extending a lease is to help the client identify the ‘competent landlord’. Without getting too legally technical here, this basically just means the person who has the power to agree to and grant your leasehold extension for a further period of 90 years.

The competent landlord will be the person who has the most significant interest in the leasehold property you reside in – usually the actual freeholder themselves, but this could be a person known as a head lessee (something you would be best to discuss further with your lease extension solicitor). There are a few ways of going about ascertaining the relevant details of your landlord, if they are still proving to be rather elusive.

Under the Landlord and Tenant Act 1985, you have a legal right to obtain the name and address details of your landlord. It is actually an offence for your landlord to fail to respond to you within a period of 21 days.

You are also entitled to inspect the register of freeholders at the Land Registry. This should provide you with the relevant details of the freeholder for your property. There is just a small charge to acquire this information.

Under s.41 of the Leasehold Reform, Housing & Urban Development Act 1993 (as amended), you are further entitled to submit what is known as an ‘Information Notice’. This is served on the freeholder of the property and orders them to furnish you with the information pertaining to the interest of your leasehold within a period of 28 days.
